Welcome to Prodigy MMA, operated by BJJ247 Pty Ltd T/A Prodigy MMA ("we", "our", or "us"). These Terms of Use ("Terms") govern your use of our website, newsletters, emails, and related digital content (collectively, the “Services”).

By accessing or using any part of our Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.

We reserve the right to modify these Terms at any time. Changes become effective upon posting. Your continued use of the Services following any updates constitutes acceptance of those changes.

1. Copyright and Intellectual Property

All content available via the Services, including but not limited to text, images, graphics, software, audio, video, and other materials ("Content"), is the property of BJJ247 Pty Ltd T/A Prodigy MMA or its content suppliers and is protected under Australian and international copyright laws.

You may not copy, reproduce, distribute, modify, create derivative works from, publicly display or perform, republish, download, store, or transmit any Content without our prior written permission, except as expressly allowed by law.

2. Use of Services

Our Services are provided for personal, non-commercial use only. You agree not to:

Use the Services for any unlawful purpose.
Modify, distribute, or exploit any Content without authorisation.
Attempt to gain unauthorised access to our systems or networks.

3. Product Sales and Merchandise

Products and merchandise available through our Services are subject to availability and may be discontinued at any time. We strive to provide accurate product descriptions, but we do not warrant that product information or pricing is error-free.

All purchases are subject to our separate Terms of Sale and Return Policy, available [insert link if applicable].

4. Disclaimer of Warranties

The Services and all Content are provided "as is" and "as available" without warranties of any kind, either express or implied. To the fullest extent permitted by law, we disclaim all warranties, including:

5. Limitation of Liability

To the extent permitted by law, BJJ247 Pty Ltd T/A Prodigy MMA and its officers, employees, or affiliates shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from:

Your use or inability to use the Services
Errors or omissions in the Content
Purchase or use of any product or service through the Services

In any event, our total liability to you for any claim shall not exceed AUD $100.

Our Services may include links to third-party websites or content not owned or controlled by us. These are provided for your convenience and do not imply endorsement. We are not responsible for any content, privacy practices, or actions of third-party sites.

7. Indemnification

You agree to indemnify and hold harmless BJJ247 Pty Ltd T/A Prodigy MMA, its affiliates, officers, and employees from any claims, liabilities, damages, losses, or expenses arising from your use of the Services or breach of these Terms.

8. Export Control

You are responsible for complying with all local laws regarding the import, export, or re-export of Content or merchandise. You agree not to access or download Content in violation of Australian export laws.

9. Governing Law and Jurisdiction

These Terms are governed by the laws of New South Wales, Australia. You consent to the exclusive jurisdiction of the courts in New South Wales for any disputes arising under or in connection with these Terms.

10. Termination

We may suspend or terminate your access to the Services at any time, without notice, if we believe you have breached these Terms. Upon termination, you must cease all use and destroy any Content obtained through the Services.

11. Entire Agreement

These Terms constitute the entire agreement between you and BJJ247 Pty Ltd T/A Prodigy MMA regarding the use of our Services and supersede any prior agreements or understandings.

Waiver and Release of Liability (for Gym Services)

Waiver and Release of Liability
By participating in any training, class, or event with Prodigy MMA, you acknowledge and agree to the following:

Assumption of Risk
I understand that martial arts and fitness training involves physical activity with inherent risks, including but not limited to injury, strain, or accidents. I voluntarily assume full responsibility for any risks or injuries incurred.
Medical Clearance
I certify that I am in good physical condition and have no medical condition that would prevent safe participation.
Release of Liability
I release and hold harmless BJJ247 Pty Ltd T/A Prodigy MMA, its instructors, agents, and affiliates from any claims, liability, or demands arising from my participation, whether caused by negligence or otherwise.
Photography & Media
I consent to the use of photos or videos taken during training for promotional purposes unless I opt out in writing.
Minors
If signing on behalf of a minor, I confirm I am their parent or legal guardian and accept full responsibility.

1. Membership Types & Fees	· Membership options include casual visits, fortnightly direct debit plans, and unlimited access packages. · All fees are payable in advance via direct debit unless otherwise agreed. · Memberships are non-transferable and non-refundable unless required by law. Direct debit dishonours attract a $10 fee which is billed to the member in the following fortnight billing cycle.
2. Cooling-Off Period	A 14-day cooling-off period applies from the date of joining. Written notice must be provided within this period to cancel membership.
3. Membership Suspension / Freeze	Memberships can be frozen for a minimum of 2 weeks and a maximum of 8 weeks per request. A maximum of two freeze periods of 8 weeks (16 weeks total) are allowed per calendar year. All freeze requests must be submitted in writing with a minimum of 7 days’ notice.
4. Cancellation Policy	Members must provide 28 days' written notice to cancel their membership outside of cooling-off period. All outstanding fees must be paid before cancellation is accepted and processed. All outstanding fees must be paid before cancellation is finalised. There is no fixed-term contract; memberships are ongoing unless cancelled.
5. Upgrades and Downgrades	Upgrades can be applied immediately upon request. Downgrades require 14 days' written notice. Changes in membership tier will affect fees accordingly.
6. Access and Use	Members may access the gym during operating hours or according to their membership tier. Members under the age of 16 must be accompanied by a responsible adult. Appropriate attire, hygiene, including use of a towel is mandatory.
7. Health & Safety	Members are responsible for ensuring they are medically fit to participate. Prodigy MMA is not liable for injuries resulting from participation in training or use of equipment. All medical conditions must be disclosed at the time of joining.
8. Rules of Conduct	Members must treat staff and fellow members with respect at all times. Abusive, aggressive, or antisocial behaviour will not be tolerated and may result in termination of membership.
9. Liability & Waiver	All activities are undertaken at the member's own risk. Prodigy MMA is not responsible for loss or theft of personal belongings. Members release Prodigy MMA from liability to the extent permitted by law.
10. Photography & Media	Prodigy MMA may occasionally take photos or videos for promotional purposes. Members can opt out by notifying staff in writing.
11. Changes to Terms	Terms and conditions may be updated with 30 days’ notice. Members will be notified of any major changes via email or public posting in the gym.
12. Dispute Resolution	Complaints should be directed to gym management in the first instance. Unresolved disputes may be escalated to the relevant consumer protection authority.
13. Governing Law	These terms are governed by the laws of New South Wales, Australia.
